| 科技期刊是科技工作者发表、交流研究成果和学术创新的传播体制和工程平台,对于引领科技发展、促进科技成果应用以及助力科技自立自强扮演着不可或缺的重要角色。然而,利用竞价排名机制进行虚假科技期刊诈骗的现象层出不穷,且治理效果不佳。本文通过梳理虚假科技期刊网站诈骗现状及治理必要性,分析竞价排名服务的法律性质、竞价排名服务提供商的法律地位,从而界清竞价排名服务提供商的注意义务边界,总结出治理虚假科技期刊网站诈骗的新抓手,为更好治理我国长期存在的学术诈骗提供有效解决方案。 |

| Scientific journals are a communication system and engineering platform for scientific and technological workers to publish and exchange research results and academic innovations. They play an indispensable role in leading scientific and technological development, promoting the application of scientific and technological achievements, and helping scientific and technological self-reliance. However, the phenomenon of using the bidding ranking mechanism to commit fraud in fake scientific journals is endless, and the governance effect is not good. This article sorts out the current situation of fraud on fake scientific journal websites and the necessity of governance, analyzes the legal nature of bidding ranking services and the legal status of bidding ranking service providers, thereby clarifying the boundaries of the duty of care of bidding ranking service providers, and summarizing new approaches to governance of fraud on fake scientific journal websites, providing effective solutions for better governance of academic fraud that has long existed in China. |
