| 科技期刊是科技工作者发表、交流研究成果和学术创新的重要平台,在引领科技发展、促进科技成果应用以及助力科技自立自强方面扮演着不可或缺的重要角色。然而,利用竞价排名机制进行虚假科技期刊诈骗的现象层出不穷,且治理效果不佳。本文通过梳理虚假科技期刊网站诈骗现状及治理必要性,分析竞价排名服务的法律性质、竞价排名服务提供商的法律地位,从而界清竞价排名服务提供商的注意义务边界,总结出治理虚假科技期刊网站诈骗的新抓手,为更好解决我国长期存在的学术诈骗问题提供有效解决方案。 |

| Sci-tech journals serve as a pivotal communication system and engineering platform for scientific and technological professionals, facilitating the publication and exchange of research findings and academic innovations. They hold an indispensable position in guiding sci-tech advancements, fostering the application of research achievements, and fostering technological self-reliance. Yet, the perpetual occurrence of fraud through the utilization of bidding ranking mechanisms in fake sci-tech journals remains a pressing issue, with governance efforts yielding inadequate results. This article delves into the current landscape of fraudulent activities on fake sci-tech journal websites and underscores the necessity of effective governance. By examining the legal nature of bidding ranking services and the status of service providers within the legal framework, it clarifies the boundaries of their duty of care. Furthermore, the article summarizes novel governance approaches tailored to address fraud on fake sci-tech journal websites, offering practical solutions to the longstanding challenge of academic fraud in China. |
