      随着生成式人工智能在科技期刊内容生产中的广泛应用,人工智能生成内容(Artificial Intelligence Generated Content, AIGC)的可版权性认定面临严峻挑战。本文系统剖析科技期刊视域下AIGC可版权性的理论分歧、法律标准与实践路径,旨在构建一套兼顾法律合规与出版可行的治理框架。综合规范分析与案例研究发现,当前理论界围绕“人类作者中心主义”形成“否定说”与“肯定说”的分野;在司法实践中,中美典型案例均将“人类主导”和“实质性智力投入”作为核心裁判标准。本文主张,AIGC可版权性应采取个案认定的精细化路径,依据人类在生成过程中的创造性贡献程度进行判断。为此,本文提出,应从建立强制披露、明确贡献审查、完善合同确权及推动行业协同4个维度,构建系统化、可操作的版权治理体系,以规范人机协同下的学术出版行为,促进AIGC技术健康有序地赋能学术创新。
英文摘要:
      The widespread application of generative artificial intelligence (Artificial Intelligence Generated Content, AIGC) in the content production of sci-tech journals poses a severe challenge to the determination of the copyrightability of the generated content. This article systematically analyzes the theoretical differences, legal standards, and practical paths regarding the copyrightability of AIGC from the perspective of sci-tech journals, aiming to construct a governance framework that balances legal compliance and publication feasibility. Through comprehensive normative analysis and case studies, it is found that the current theoretical community has divided into “negative view” and “positive view” based on the “human author-centeredism” concept. In judicial practice, both Chinese and American typical cases have regarded “human dominance” and “substantial intellectual input” as the core judgment criteria. This article advocates that the copyrightability of AIGC should adopt a refined individualized determination path, judging based on the degree of creativity contributed by humans in the generation process. Therefore, this article proposes that four dimensions should be established:mandatory disclosure, clear contribution review, improvement of contract rights confirmation, and promotion of industry collaboration, to build a systematic and operational copyright governance system, in order to regulate academic publishing behavior under human-machine collaboration and promote the healthy and orderly empowerment of AIGC technology for academic innovation.
