| 为了研究国内商业期刊数据库支付的著作权使用费的分配问题，在介绍当前数据库与出版单位、出版单位与著作权人、数据库与著作权人之间的支付现状基础上，对期刊的整体著作权和论文的著作权归属进行了讨论，根据著作权归属对著作权使用费的分配提出了意见，并对著作权使用费存在的误用可能导致的法律和财务风险，提出了一些建议，为规范出版行为、消除廉政风险提供参考。 |

| In order to study the distribution of copyright royalties paid by domestic commercial journal databases, this paper introduces the current status of payment between databases and the editorial department, the editorial department and authors, databases and authors. Then, it discusses the overall copyright of the journal and the copyright ownership of papers, and gives some advices on the distribution of copyright royalties according to the copyright ownership. It puts forward some suggestions on the legal and financial risks caused by the misuse of copyright royalties, which can provide reference for standardizing publishing behavior and eliminating the risk of clean government. |
