| 我国出台行政法规鼓励非公有资本参与出版中下游产业,但是科技期刊的控制经营依旧是非公有资本的法律“禁区”。在实践层面,非公有资本早已悄然进入到科技期刊出版领域,造成了租售稀释版面、滥收版面费,期刊与中介勾连、逐级分销版面,申请境外刊号、规避禁入政策等乱象。非公有资本渗透科技期刊出版领域归因于科技期刊办刊资金普遍不足,科技期刊版面供需结构紧张,科技期刊市场化道路推波助澜。针对非公有资本渗透科技期刊办刊产生的诸多风险,本文从民法层面、行政法层面、刑法层面和国家安全法层面提出了综合规制的建议。 |

| China has promulgated administrative regulations to encourage non-public capital to participate in the publication of midstream and downstream industries, but the control and operation of scientific journals is still a legally forbidden zone. In practice, non-public capital has already quietly entered the field of scientific and technological journal publishing, causing chaos such as renting and selling diluting pages, overcharging pages, journals colluding with intermediaries, gradual distribution of pages, applying for overseas journal numbers, and evading prohibition policies, etc. The penetration of non-public capital into the publishing field of sci-tech journals is attributed to the general lack of funding for sci-tech journals, the tight supply and demand structure of sci-tech journals, and the marketization of sci-tech journals. The penetration of non-public capital into sci-tech journals has caused a lot of risks. In view of the many risks arising from the infiltration of non-public capital into scientific journals, this article proposes comprehensive regulatory recommendations from the level of civil law, administrative law, criminal law, and national security law. |
